I do believe it impacts all Homeless Posts and there are a great many within VFW who have never owned or rented property.
I agree with the rule / law if Real Property (Real Estate) or Personal Property is involved. OR - if unpaid officers or employees are not protected from suit by State Law or in any way other than through Insurance.
We, here in MA, recently had a suit against a local youth sport league. A youngster had hit his head on equipment and a suit against the League ensued. All unpaid Volunteers. Not State, City or Town supported!
Just Mom's, Dads, Brothers & Sisters. All a part of the suit.
It was appealed to the Massachusetts Supreme Court which ruled in favor of the League citing an old law, still on the books, written in the days when citizens were encouraged to participate in the name of the Common Weal. Unpaid volunteers of Non-Profit's can not be sued except for negligence or deliberate fault..
Our Buddy Poppy drives are on the sidewalk outside either a CVS or a Sudbury Supermarket. Both in a Mall
The sidewalk area is covered by the tenant's Insurance [Snow removal, etc). We always seek permission from the tenants.
They have always participated with us.
The Supermarket marks down to cost all items we have "identified" as needed by the deployed or their families on their shelves.
You would be surprised at the amount of goods purchased by our towns folk and given to us for them.
It then is carted [by volunteers in their vans] to Hanscom Airport, Bedford, MA to be "cubed" (more volunteers) for transport overseas ASAP with next flight having room.
Members of that Sports League are members of my Post. The Malls are both locally owned and the tenants are extremely supportive.
And! The members who work the drives are NOT just WW2. They include Korean, VIETNAM, Gulf, and non-member supporters. A warm car with a hot Thermos of coffee really helps on Armistice Day. Buddy Poppy & our Food Drive are our only activities in public.
We do have information circulating through schools informing of a Post prize for a winning submission in either or both Patriots Pen or Voice of Democracy. Nothing submitted yet.
We do have a [EIN] number and report (E-postcard) annually.
I would hate to see our Post required to turn in it's Charter but doubt very much we will ever Incorporate at this stage of the game.

Massachusetts has a law: Chapter 12: Section 8E that causes me pause regarding Incorporation of of our Post. NO REAL PROPERTY! -- NO PERSONAL PROPERTY!
Our ONLY asset is our checkbook. We as unpaid members of our Post CAN NOT be sued under our State's Supreme Court's Decision.
Not in favor of supporting the legal community.

Excuse me for treading amongst alligators. As I read newer news from the Convention I keep notice of "Posts 'shall' be Incorporated."
To the best of my knowledge my Post has NEVER been Incorporated in it's almost forty years of existence.
We are New Englanders and historically stubborn. Is there a way out for us?
We own absolutely nothing of value. A Homeless Post with no intention of ever owning real estate. We never have! We are true volunteers!

Reading the posts in the BlogMaster Group, posted in the last 24 hours, cause me to reflect on a difference between our identities as we comment on our activities for our own Posts.
In the Forum we can link our posts for anyone wishing to view our work and perhaps come away with new ideas. While visiting we can access Photo Album or Archives where we can read past postings as long as you know the title or have lots of time.
Would you feel we might have our individual Post's link in this group as we comment?

Yes! I have passed to my eldest daughter my wit.She is an excellent writer and grandmother. Prettier than a new car.

Yes to the will. It's in a safe place. So safe I have forgotten just where. The Runt is my eldest daughter. Like you, 'born at an early age.' She does not like her picture taken. This I clipped out of a magazine. She was standing between two very tall men. [Not FBI]. The three were involved in a Charity Drive on Boston Common.
I regret to say I cropped the dudes out with nary a thought. It's the only recent picture I have of her.
